Terms and conditions of membership
AREV CLUB TERMS AND CONDITIONS
YOU MUST READ THESE TERMS CAREFULLY BEFORE TAKING OUT MEMBERSHIP WITH THE COMPANY. BY APPLYING FOR MEMBERSHIP OR FOR PARTICIPATION IN AN EVENT OR ACTIVITY YOU AGREE TO THESE TERMS AND CONDITIONS AND THE CODE OF CONDUCT.

- DEFINITIONS
“Hotel Facilities” means restaurants, bars, pools, pool bar, spa, gym, and Place des Oliviers, and car park.
"The Company" means SAS Lou Tropez, registered in France with an address of 8 Chemin des Vendanges, 83990 Saint-Tropez.
“The Hotel" means Arev St. Tropez.
"Member or member" means any Member of Arev Club or any person or persons intending to or who have applied for Membership of Arev Club.
"You" means any person who is a member prospective member or past member of Arev Club or where the context permits a guest of a member.
"Site" means all websites listed below in clause 4.1 and any official Hotel or Club Facebook Pages, Instagram, or Groups, together with all material on those websites or sent to you by e-mail or by any other means. Reference to the Site includes all intellectual property rights on the Site including but not limited to copyright, trademarks, database, member details and moral rights.
"Terms" mean these terms and conditions and any subsequent amendments as may be notified to you.
"Working day" is any day other than weekends and bank or other public holidays.
4 FORMATION OF THE CONTRACT
4.1 These terms apply to all services and any goods supplied by the Company through the following domain and sub domain or other means:
4.1.1 www.arevcollection.com together with any other Company domains and sub domains listed on any of the Sites or any sub domains and any terms relating to the use of the Site(s) shall also apply.
4.2 Any quotation or information given by the Company is only an invitation to you to apply for membership with the Company. No contract exists between you and the Company until the Company has received and accepted your application and sends you confirmation of acceptance.
5 MEMBERSHIP
5.1 Membership to the Arev Club (hereinafter "the Club") is subject to these Terms and Conditions.
5.2 The Membership Committee meets as needed and makes the final decision on who shall become a member of Arev Club.
5.3 You are free to withdraw your application at any time. Should you wish to do so, please contact our membership team at arevclub@arevcollection.com. If your membership application is accepted, we will confirm this by sending you a 'Welcome to the Club’ email and a membership within thirty (30) days. Your annual membership will commence on the date your 'Welcome to the Club' email is sent (“Start Date”).
5.4 Hotel reserves the right to refuse or revoke membership at its discretion.
5.5 Members are welcome to propose new applicants to join the Club. Application forms are available by emailing arevclub@arevcollection.com.
5.6 Membership is for a minimum period of one year and renewable thereafter on an annual basis. Membership renewals are not automatic and are reviewed by our Membership Committee on an annual basis. Their decision is final and without appeal.
5.7 It is important for us to have your current details, plus a photograph of you in our membership database. By becoming a member of the Club, you agree that we can hold your personal details and a photograph to use in connection with your membership. If your contact or payment details change, please let us know via arevclub@arevcollection.com.
5.8 Upon approval or renewal of your membership, your membership fees become payable immediately. By providing us with your payment details, you accept and agree to being charged membership fees in the form requested by the Hotel upon your application being approved or renewed. It is within our discretion to amend our membership fees at any time, and we will notify you in advance if there are to be any changes to the amount, date or frequency of the payment of your membership fees.
5.9 The annual membership fee for 2024/2025 is €10,000 (exclusive of VAT) (“Club Fees”), which includes a €3,000 credit for use in Food & Beverage and Spa Services (exclusive of VAT) (“Credit). The Credit can be used to purchase food and beverage items, and spa services, at the Hotel in accordance with the Hotel terms and conditions. Your Credit will be added to your account shortly after your Club Fees have been collected. You will receive an email when they are ready to spend.
5.10 Failure to pay the annual subscription (or any instalment) within one month of the due date will result in the member not being admitted to the Club and the membership being terminated.
5.11 Membership is valid for one year from the Start Date.
5.12 Membership is personal and non-transferable.
5.13 Membership Fees are non-refundable.
5.14 A member shall be entitled to all the rights and privileges of the Hotel granted to a person in their capacity as a member and shall be bound by these rules but shall have no proprietary rights in any of the premises or in respect of property of the Hotel.
6 MEMBERSHIP CREDITS
6.1 These terms and conditions govern the use and redemption of the Member Credits, to be received by you or the specified member on receipt of your payment of the Member Credits, to purchase food and beverage items and spa services at the Hotel in accordance with the terms below (“Member Credits”).
Use of Member Credits constitutes your acceptance of these terms and conditions and the accompanying Member Credits FAQs which can be found at __________________(the “FAQs”) and which are between you and the Company. These terms and conditions and the FAQs are subject to change or modification by the Company at any time without prior notice.
6.2 Member Credits can be used for a period of twelve (12) months from the date they are issued to you (the “Usage Period”) at the Hotel and only against the following: (a) food and beverage purchases at the Hotel; and (b) spa services at the Hotel. Any unused Member Credits will expire at the end of the Usage Period.
6.3 Please note that if you spend Member Credits on food and beverage items in the Hotel your Member Credits may be used to cover any service charge but not tips on your bill.
6.4 Unless otherwise provided in these terms and conditions, any of your outstanding Member Credits will automatically expire at the end of the Usage Period, at which point they can no longer be spent.
6.5 If a membership is terminated by the Company, any of the outstanding Member Credits will immediately expire on the date of termination of said membership and will no longer be able to be used.
6.6 Member credits are non-transferable, non-exchangeable and (other than as provided for in the terms and conditions) non-refundable and cannot be redeemed for cash, unless required by law or otherwise permitted by these terms and conditions. Member credits cannot be used in combination with any other Hotel promotions, special events or discounts.
6.7 Company does not accept responsibility for any unauthorized use or loss of your Member Credits.
6.8 To the extent permitted by applicable law, Company, and Hotel’s entire liability with respect to any issuance or redemption of your Member Credits under contract or tort is limited to €10.00. The company shall not be liable to you for any special, consequential, incidental, punitive or indirect damages arising from or related to the issuance of your Member Credits regardless of any notice of the possibility of such damages. Nothing in this paragraph is intended to limit, exclude or restrict indemnification rights or obligations or anything else which cannot be excluded as a matter of law.
6.9 The face value of your Member Credits issued to you includes any applicable value added taxes/sales taxes.
7 MEMBERSHIP BENEFITS

7.1.1 Arev Padel court (reservation required, maximum 3 times per week) and to be booked in advance by contacting host@arevcollection.com or calling the hotel on XXX
7.1.2 Hammam
7.1.3 Swimming pool
7.1.4 Gym
7.2 Discounts:
7.2.1 10% off Food & Beverage
7.2.2 No buyout fees for private events
7.2.3 10% off Spa treatments, private coaching, and Maison ST Boutique
7.2.4 15% off Accommodation with confirmed upgrade at time of booking, based on availability (blackout dates apply)
7.2.5 15% off Arev Boutique
7.3 Complimentary Services (subject to availability):
7.3.1 Parking
7.3.2 Shuttle from home to Arev (on reservation - Saint-Tropez vicinity only)
7.3.3 Shuttle to town
7.3.4 Use of Arev bikes
7.4. Welcome Gift: Arev bag, Arev cap, and choice of an Arev Apparel item
7.5. Monthly billing option for charges incurred at the hotel. Charges will be invoices on the 1st of the month for charges the previous month or any pro-rata portion thereof. Payments are due within 10 days of receipt.
8 MEMBER GUEST POLICY
8.1 Members may take guests to the Padel court and restaurant. Up to three guests maximum can be taken to Padel court.
8.1.1 Guests must be always accompanied by the member.
8.1.2 The hotel reserves the right to further limit the number of guests per member.
8.2 No children under the age of 14 are permitted in the Hotel Facilities.
9 RESERVATIONS AND AVAILABILITY
9.1 All services and facilities are subject to availability.
9.1.1 Reservations are required for the Padel Court and are limited to 3 times per week per member and can be made by contacting reservationsstt@arevcollection.com
9.1.2 Blackout dates may apply for accommodation discounts.
9.2. Seasonal Restrictions
9.2.1 The Hotel reserves the right to restrict membership access during certain months (high season).
9.2.2 Members will be notified in advance of any seasonal restrictions.
10 PRIVACY AND DATA
10.1 We will use the personal information you provide us in connection with your membership in accordance with our Privacy Policy.
10.2 The Hotel management and all staff members are required to adhere to the strictest confidentiality standards, and pledge to maintain all records and personal information concerning the members and their guests in the strictest confidence.
10.3 While you are a member or a guest at our Hotel, we may ask you to give your views of, and experiences at, Arev. We may also film, video or photograph our member events and activities at our Hotel for use in our membership programs, as well as advertising, promotions, public relations, and other commercial/business purposes. If you take part in these interviews or events, you agree to us using your name, image and limited other information. You also consent to us publishing any materials produced by, or for, us for any purpose without your further consent, and you waive your right to receive any payment from us in connection with such publication. When we host events in the Hotel that we are recording, we will endeavor to display signs to make this clear to members and guests.
11 SAFETY AND SECURITY
11.1 Accidents and injuries. We want all our members and guests to relax and enjoy the activities and facilities available at our Hotel safely. Members and their guests agree to observe the Hotel rules, and any signs published or displayed at our Hotel at any time; to only swim in designated areas; and to take reasonable precautions when travelling around the grounds or using the facilities at the Hotel.
If a member or guest has had an accident or suffers any injury at, or in the vicinity of, the Hotel, please report this as soon as possible to a member of staff and, in any event, within 24 hours of the incident. As well as making our members’ and guests’ wellbeing a priority, this information is needed in order to help us comply with our health and safety obligations and for insurance purposes.
11.2 Members use the facilities at their own risk. Use of any of the gym or fitness equipment, areas or facilities available at the Hotel is entirely at risk of a member or hotel guest. Members are not permitted to bring guests to the gym. Introduction sessions explaining how to safely and properly use the gym or fitness equipment are available. You must not use any equipment, or undertake any activity at the Hotel, unless you are satisfied that you are competent to do so in a safe and proper manner. You will also be required to complete a health commitment statement confirming that you are in good health and in a fit state to use our gyms.
When using any equipment and facilities available at the Hotel, you must take care to safeguard your own health and safety, and that of other people. You will be solely responsible for any loss or injury that you cause to yourself, other persons, or to the equipment or facilities through your unsafe or improper use of the equipment or facilities. This includes your use of them while under the influence of alcohol or medication, or your failure to advise staff of a medical condition relevant to your use of the equipment or facilities.
12 LIABILITY OF HOTEL
12.1 All items brought into and/or left in the Hotel are entirely at the risk of the member or their guests. Hotel, its servants and/or agents shall not be liable to any member or guest for any loss, damage or injury suffered by them or their property howsoever caused, save in respect of death or personal injury to a member or guest to the extent caused by the gross negligence of the Hotel, its servants and/or agents. This is not intended to affect any mandatory rights a member or guest may have under local law that we cannot legally restrict or exclude.
12.2 Hotel is not liable for any loss, damage, or injury resulting from the use of Club facilities.
13 INDEMNITY
13.1 You agree to indemnify and hold the Company harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms or arising from your negligence or breach of duty.
14 CCTV
Members and their guests should be aware that for safety reasons, we use CCTV in our Hotels. We do not provide CCTV footage, except pursuant to a police request as part of an active investigation, or as required by subpoena or law.
15 GENERAL
15.1 The Company may amend these Terms at any time by giving you notice ("Notice") by either e-mail or by posting the amended Terms on the Site. Any amended Terms will govern new transactions from the date that they are posted on the Site. Existing members will be bound by the amended Terms after the expiry of 30 days following the date of a Notice.
15.2 Each right or remedy of the Company under the Terms is without prejudice to any other right or remedy of the Company whether under the Terms or not.
15.3 If any provision of the Terms is found by any court, tribunal or administrative body of competent jurisdiction to be wholly or partly illegal, invalid, void, voidable, unenforceable or unreasonable it shall to the extent of such illegality, invalidity, voidness, voidability, unenforceability or unreasonableness be deemed severable and the remaining provisions of the Terms and the remainder of such provision shall continue in full force and effect.
15.4 Failure or delay by the Company in enforcing or partially enforcing any provision of the Terms will not be construed as a waiver of any of its rights under the Terms.
15.6 Neither the Company nor you intend that any term of this Contract will be enforceable by any person that is not a party to it other than someone to whom the Company transfers its rights under this Contract.
15.7 The Company may assign the benefit of any contract to any person, firm or company.
15.8 These terms and conditions are governed by the laws of France.
